Terms of Service

1. Who these terms are between
These Terms of Service ("Terms") govern your use of the PathOS platform ("PathOS", "the Service"), operated by PathOS Labs("we", "us"). PathOS is a business operations tool provided to diagnostic laboratories and their franchise collection centres (each, a "Lab") and used by the Lab's staff and authorised operators ("you"). By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.
PathOS is not a diagnostic provider. Test results, reports and medical information are produced by the Lab and its laboratory information system; PathOS only helps deliver and organise them.
2. Accounts and access
- Access is granted by the Lab or by an administrator; you may use only an account assigned to you.
- Sign-in is through your Google account. Keep your credentials and device secure and do not share access.
- You are responsible for activity carried out under your account.
- Tell an administrator promptly if you believe an account has been compromised.
3. Acceptable use
You agree not to:
- access or attempt to access patient or financial data outside the centres and scope your role permits;
- use patient data for any purpose other than providing the Lab's diagnostic service;
- export, copy or disclose data except as needed for that service and permitted by the Lab;
- send messages through the Service that are unlawful, misleading, or in breach of WhatsApp's or Meta's policies;
- probe, scan, overload, reverse-engineer, or interfere with the Service or its security;
- upload malware or attempt to gain unauthorised access to any system or account.
4. Patient data and privacy
The Lab is the data fiduciary for patient personal data; PathOS processes it on the Lab's instructions. Your handling of personal data through the Service must follow the Lab's instructions, applicable law, and the Privacy Policy, which forms part of these Terms. The Privacy Policy also explains how a person can request deletion of their data.
5. Third-party services
The Service relies on third parties including Meta (WhatsApp Cloud API), Google, AI language and model providers, and the Lab's laboratory information system. Your use of features that depend on them is also subject to their terms, and we are not responsible for their availability or acts. The third parties in use are listed in the Privacy Policy.
6. Availability and changes
We aim to keep the Service available but do not guarantee it will be uninterrupted or error-free. We may add, change, suspend or remove features, and may perform maintenance, with or without notice. We may change these Terms; the updated version takes effect when posted here and, for material changes, will be communicated through the Lab or in the application.
7. Suspension and termination
We or the Lab may suspend or end your access at any time, including for a breach of these Terms, a security concern, or when your role or engagement with the Lab ends. On termination your right to use the Service stops; data handling after that follows the Privacy Policy and the Lab's instructions.
8. Intellectual property
The Service, its software and its design are owned by PathOS Labsand its licensors. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service for the Lab's operations while your access is valid. Data entered by the Lab and its patients remains the Lab's and the patient's, as set out in the Privacy Policy.
9. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind to the maximum extent permitted by law. PathOS does not provide medical or diagnostic advice; rely on the Lab and a qualified professional for interpretation of any report.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential losses, or for loss of profits, revenue, data or goodwill, arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited under applicable law.
11. Indemnity
You agree to indemnify PathOS Labs against claims, losses and expenses arising from your use of the Service in breach of these Terms or of applicable law.
12. Governing law
These Terms are governed by the laws of India. The courts at Telangana, India have exclusive jurisdiction, subject to any right you have under applicable law to bring proceedings elsewhere.
